1. Agreement to Terms
Made It Home is operated by Hey June, Inc. ("we," "us," or "our"). By downloading, accessing, or using the Made It Home mobile application ("App") or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
The Service is offered only in the United States and is available only to users who are at least 18 years of age. By using the Service, you represent that you are at least 18 and located in the United States.
2. Description of Service
Made It Home is a personal safety application that lets you:
- Start a check-in session with a time you expect to be back, and receive reminders before your time is up;
- Check in to mark yourself safe, which ends the session and lets your contacts know you are okay;
- Have your trusted contacts ("Circle of Trust") notified if you do not check in by your expected return time;
- Trigger an SOS that immediately notifies your Circle of Trust that you may need help;
- Optionally enable location and battery-level sharing during a session, and allow the App to collect photos taken during the session from your device. Anything you choose to share is shown to your Circle of Trust only when an alert is triggered (for example, a missed check-in), and is otherwise not visible to them; and
- Build and manage a Circle of Trust of up to three contacts who receive alerts on your behalf and who must accept an invitation before they are added.
3. Nature of the Service and Best-Effort Basis
The Service provides a method for notifying the contacts you choose, according to the instructions you set (your check-in times and your Circle of Trust). That is the full extent of our role. You are responsible for your own safety. We are not responsible for your safety, and we do not provide emergency response, monitoring, security, dispatch, or rescue services.
The Service operates on a best-effort basis. Delivering a notification depends on a chain of systems and conditions that we do not fully control, including but not limited to:
- the availability and correct operation of our own servers and software, including outages or errors on our part;
- the availability, performance, and accuracy of the data centers and cloud infrastructure we rely on;
- third-party services such as SMS providers (for example, Twilio and Azure Communication Services), push-notification services, and payment processors being unavailable, delayed, or behaving incorrectly;
- mobile carriers, networks, and internet connectivity;
- your and your contacts' devices, battery, settings, permissions, and choices.
Any link in this chain may fail, be delayed, be unavailable, or behave incorrectly. We do not guarantee that any notification will be sent, delivered, received, accurate, timely, or acted upon.
4. Important Safety Disclaimer
MADE IT HOME IS NOT A SUBSTITUTE FOR EMERGENCY SERVICES. IN AN EMERGENCY, ALWAYS CALL 911.
The SOS feature does NOT contact 911 or any emergency dispatcher. It only notifies the contacts in your Circle of Trust.
The Service is a supplementary personal safety tool. It is not monitored by emergency dispatchers and does not contact emergency services on your behalf. The Service detects only that you did not check in; it cannot determine whether you are actually in danger, and it does not automatically detect emergencies (for example, it has no fall, crash, or health detection). It is not a medical device.
You acknowledge and agree that:
- The Service does not replace calling emergency services;
- We are not an emergency response service, security company, or law enforcement agency;
- Your Circle of Trust members are personal contacts, not professional responders; they have no obligation to act, and we do not vet them;
- Alert delivery depends on network conditions, carrier reliability, and your contacts' device availability, and your contacts may be asleep, unreachable, or may not respond;
- The Service may experience downtime, delays, or failures; and
- You should not rely solely on Made It Home for your personal safety.
5. Your Safety Responsibilities
Because the Service depends on your setup and on conditions outside our control, you are responsible for:
- Keeping your Circle of Trust contacts' names and phone numbers accurate and current;
- Confirming that each contact has agreed to be contacted and understands they may receive safety alerts;
- Setting realistic check-in times;
- Keeping your device charged, connected, and configured with the permissions the Service needs (such as notifications and, if you choose, location);
- Testing that the Service works as you expect; and
- Maintaining other personal safety measures and not treating the Service as your only safeguard.
6. Account Registration
To use the Service, you must register using a valid phone number. We will send you a one-time verification code ("OTP") via SMS. You are responsible for:
- Providing an accurate phone number that you own or are authorized to use;
- Maintaining the security of your account;
- Completing your profile by providing your name; and
- All activity that occurs under your account.
You may only maintain one account. We reserve the right to suspend or terminate accounts that we reasonably believe are duplicates or fraudulent.
7. Circle of Trust
When you add contacts to your Circle of Trust, you represent that:
- You have a genuine personal relationship with the contact;
- You have the contact's permission to add their phone number to the Service;
- You understand that the contact will receive SMS messages and/or push notifications when alerts are triggered; and
- You will not add contacts for the purpose of harassment, spam, or any unlawful purpose.
Circle of Trust members who are not yet users of Made It Home will receive SMS messages from us on your behalf. You are responsible for informing your contacts that they may receive these messages. Phone numbers are sometimes reassigned, so a message could reach a number's new owner; keeping your contacts current is your responsibility.
8. Subscriptions and Payments
8.1 Free Trial
New users receive one free check-in session. After the free trial, a paid subscription is required to create additional sessions.
8.2 Subscription Plans
We offer Individual and Family subscription plans at monthly and annual billing intervals. Current pricing is available within the App.
8.3 Billing, Auto-Renewal, and Cancellation
Subscriptions and gift purchases are processed by our payment provider, Stripe. Subscriptions automatically renew at the end of each billing period (monthly or annual) at the then-current price, and your payment method is charged at the start of each new period, unless you cancel before the period ends. You can manage or cancel your subscription at any time through the in-app subscription management, which opens the Stripe customer portal. Cancellation takes effect at the end of the current billing period, and you retain access until then. If we change subscription prices, we will give you advance notice, and the new price will apply only to billing periods after the notice.
8.4 Gift Subscriptions
Subscriptions may be gifted to other users, processed by Stripe. Gift subscriptions are non-refundable once delivered and are tied to the recipient's phone number.
8.5 Referral Program
Users may earn subscription credit by referring new users through their unique referral code. Referral credits are subject to a per-user cap and may be modified or discontinued at any time. Referral codes may not be posted publicly for mass distribution, sold, or traded.
8.6 Sponsorship
Users may request that a sponsor pay for their subscription. Sponsors will receive an SMS with a link to complete payment.
8.7 Refunds
For subscriptions and gift purchases processed by Stripe, contact us at rajat@madeithomeapp.com for refund requests.
8.8 Taxes and Currency
All prices are in US dollars. You are responsible for any applicable taxes, which may be added at checkout.
9. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose;
- Use the Service to stalk, surveil, monitor, coerce, control, or pressure another person, or to force or induce someone to add you to their Circle of Trust or to share their location;
- Trigger false SOS alerts or otherwise abuse the alert system;
- Harass, intimidate, or threaten others through the Service;
- Add contacts to your Circle of Trust without their knowledge or consent;
- Attempt to gain unauthorized access to our systems or other users' accounts;
- Reverse engineer, decompile, or disassemble any part of the Service;
- Use automated means to access the Service; or
- Impersonate another person or misrepresent your identity.
10. User Content
You retain ownership of content you provide through the Service, including profile photos and outfit photos. By uploading content, you grant us a limited, non-exclusive license to store, process, and display that content as necessary to provide the Service. We do not use your content for advertising or sell it to third parties. If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.
11. Family Plans
Family Plan owners can invite up to 5 members (including themselves) to share a subscription. The owner is responsible for payment. Members can only belong to one Family Plan at a time. If the owner's subscription expires, members receive a 7-day grace period before losing access.
12. App Store Terms
You obtain the App through third-party app stores (such as the Apple App Store or Google Play). You agree to comply with the applicable store's terms. You acknowledge that:
- These Terms are between you and Hey June, Inc. only, and not with Apple Inc. or Google LLC;
- The app stores have no obligation to provide maintenance or support for the App;
- The app stores are not responsible for addressing any claims relating to the App, including product-liability, legal-compliance, or intellectual-property claims; and
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You represent that you are not located in a country subject to a US Government embargo and that you are not on any US Government restricted-parties list.
13. Intellectual Property
The Service, including its design, features, code, and content (excluding user-provided content), is owned by us and protected by copyright, trademark, and other intellectual property laws.
14. Changes to the Service
We may modify, suspend, or discontinue any part of the Service at any time. We will try to give reasonable notice of significant changes, but we are not liable for any modification, suspension, or discontinuation of the Service.
15. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ALERTS OR NOTIFICATIONS WILL BE SENT, DELIVERED, RECEIVED, ACCURATE, OR TIMELY.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, INCLUDING ANY FAILURE OF THE SERVICE TO SEND OR DELIVER A NOTIFICATION, TO NOTIFY YOUR CONTACTS, OR TO ACCURATELY REPORT YOUR LOCATION, AND INCLUDING FAILURES CAUSED BY OUR SERVERS, DATA CENTERS, OR THIRD-PARTY SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, or death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
17. Indemnification
You agree to indemnify and hold harmless Hey June, Inc. and its affiliates from claims arising from your use of the Service, your violation of these Terms, or your addition of contacts to your Circle of Trust.
18. Account Termination
You may delete your account at any time through the App. Upon deletion, we will remove your personal data in accordance with our Privacy Policy. Cancel any active subscription through the in-app subscription management before deleting your account. We may suspend or terminate your account for violations of these Terms.
19. Dispute Resolution and Arbitration
Please read this section carefully. It affects your legal rights, including by requiring arbitration and waiving class actions and jury trials.
Informal resolution first. Before starting any formal proceeding, you agree to contact us at rajat@madeithomeapp.com and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration. Except as provided below, any dispute that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this section. The arbitration will take place in the United States, and a judgment on the award may be entered in any court with jurisdiction.
Class action and jury waiver. You and Hey June, Inc. each waive the right to a jury trial and the right to bring or participate in a class, collective, or representative action. Disputes will be resolved only on an individual basis.
Small-claims exception. Either party may bring an individual claim in small-claims court if it qualifies.
Your right to opt out. You may opt out of this arbitration agreement by emailing rajat@madeithomeapp.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out will not affect any other part of these Terms.
20. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs Section 19.
21. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App and updating the "Last updated" date. Continued use after changes become effective constitutes acceptance.
22. General
These Terms and our Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. We may provide notices to you in the App, by SMS, or by other reasonable means. Sections that by their nature should survive termination (including Sections 3 through 5 and 13 through 20) will survive. Except as stated in Section 12, there are no third-party beneficiaries to these Terms. The English-language version of these Terms controls.
